Do I need planning permisson?

Most conservatories don’t need planning permission. We will of course advise you when we see the site; meanwhile, here is a working guide.

You will need planning permission if:

  • the property has had its permitted development rights withdrawn
  • the proposed conservatory has any wall facing onto the highway, ie any public thoroughfare including paths and bridleways as well as roads
  • the property is a listed building
  • the property is in a conservation area
  • the property is non-residential
  • the property is anything other than a single building – flats and apartments always need planning permission
  • the proposed conservatory is higher than any part of the original building
  • the proposed conservatory and other additions to the original house exceed 50% of the total area of the garden
  • eaves, gutterings, fascias or foundations encroach over the property’s boundaries.

To be exempt from Building Regulations, the conservatory must:

  • have a translucent or transparent roof
  • not have more than 25% of its wall area as brickwork
  • not exceed 30m2 in area
  • be sited at ground level
  • be permanently separated by a door from the remainder of the property
  • feature toughened or safety glass
  • not be permanently heated
  • not contain drainage facilities, ie for a sink, WC or washing machine
